Justicia Restaurativa Costa Rica
La persona ofensora usuaria de justicia restaurativa será la persona imputada debidamente identificada, que de conformidad con la legislación procesal penal y penal juvenil sea señalada o incriminada como posible autora de un hecho punible o partícipe por cualquier acto de la investigación con solvencia probatoria y haya aceptado, de manera informada y voluntaria, someter su caso a justicia restaurativa.
El procedimiento restaurativo se aplicará en materia penal, penal juvenil y contravencional, en todas las etapas procesales, conforme a lo establecido en esta ley.
El Acuerdo restaurativo es el conjunto de condiciones pecuniarias, comunales, socioeducativas o terapéuticas y afines, que surgen a través del diálogo generado en la reunión restaurativa entre las partes intervinientes, el cual se integra en el plan reparador que se somete ante la autoridad jurisdiccional, a fin de judicializar los acuerdos aplicando una salida o pena alternativa, cuya homologación constituye una obligación de cumplimiento de las partes en el marco del proceso penal, penal juvenil o contravencional, cuyo seguimiento estará a cargo del equipo interdisciplinario y psicosocial de cada sede restaurativa.
CUANDO SE APLICA JUSTICIA RESTAURATIVA
Proceda la conciliación, la suspensión del procedimiento a prueba, la reparación integral del daño.
Cuando la causa se resuelva mediante el procedimiento especial abreviado, en los casos que proceda el beneficio de ejecución condicional de la pena y en aquellos supuestos en que se defina una pena alternativa no privativa de libertad.
Cuando se determine una pena en los casos cuando proceda el beneficio de ejecución condicional de la pena o en aquellos supuestos en que se defina una pena alternativa no privativa de libertad. Para la aplicación de este supuesto el debate se debe realizar mediante la cesura.
Para el seguimiento de la pena alternativa impuesta mediante la aplicación del procedimiento restaurativo y para definir los planes de atención no institucional con abordaje restaurativo.
DELITOS QUE SE EXCLUYEN DE LA LEY DE JUSTICIA RESTAURATIVA
Delitos sexuales.
Delitos contemplados en la Ley sobre Estupefacientes, Sustancia Psicotrópicas, Drogas de uso no autorizado, Actividades Conexas, Legitimación de Capitales, Financiamiento al Terrorismo, excepto el delito de Introducción de droga a centro penal en el caso de las mujeres (77 bis).
Crimen Organizado y trata de personas.
Delitos de la Ley de Penalización de Violencia contra la mujer, o los originados en situaciones de violencia doméstica o intrafamiliar contenidos en el Código Penal.
