PROCEDIMIENTO ABREVIADO

El proceso abreviado es un mecanismo que le permite a la persona acusada solicitarle al juez, antes de la audiencia preliminar o antes del juicio que se imponga la condena , ya que el acusado reconoce su culpabilidad.

Esto se fundamenta sobre el hecho de que existen suficientes pruebas que ratifican la culpabilidad del acusado y que el Ministerio Público haya manifestado su anuencia a dicho proceso abreviado. El juez debe valorar las pruebas y considerar si con estas hay suficientes indicios de la culpabilidad del acusado e impone una pena menor de lo que se impondría si el imputado fuese a juicio y resulta una condenatoria

 

PROCEDIMIENTO ABREVIADO

Artículo 373- Admisibilidad. En cualquier momento, hasta antes de acordarse la apertura a juicio, se podrá proponer la aplicación del procedimiento abreviado cuando:

a) El imputado admita el hecho que se le atribuye y consienta la aplicación de este procedimiento.

b) El Ministerio Público, el querellante y el actor civil manifiesten su conformidad.

En aquellos casos en que proceda según la normativa legal vigente, se podrá solicitar que el procedimiento abreviado sea tramitado mediante el procedimiento de justicia restaurativa.

La existencia de coimputados no impide la aplicación de estas reglas a alguno de ellos.

Artículo 374- Trámite inicial. El Ministerio Público, el querellante y el imputado, conjuntamente o por separado, manifestarán su deseo de aplicar el procedimiento abreviado y acreditarán el cumplimiento de los requisitos de ley.

El Ministerio Público y el querellante, en su caso, formularán la acusación si no lo han hecho, la cual contendrá una descripción de la conducta atribuida y su calificación jurídica y solicitarán la pena por imponer. Para tales efectos, el mínimo de la pena prevista en el tipo penal podrá disminuirse hasta en un tercio.

 

Se escuchará a la víctima de domicilio conocido, pero su criterio no será vinculante. No obstante, en los casos tramitados con aplicación del procedimiento establecido en la Ley de Justicia Restaurativa, sí será requisito de viabilidad la anuencia de la víctima a participar en el abordaje restaurativo.

Si el tribunal estima procedente la solicitud, así lo acordará y enviará el asunto a conocimiento del tribunal de sentencia.

ARTICULO 375.-Procedimiento en el tribunal de juicio. Recibidas las diligencias, el tribunal dictará sentencia salvo que, de previo, estime pertinente oír a las partes y la víctima de domicilio conocido en una audiencia oral.

Al resolver el tribunal puede rechazar el procedimiento abreviado y, en este caso, reenviar el asunto para su tramitación ordinaria o dictar la sentencia que corresponda. Si ordena el reenvío, el requerimiento anterior sobre la pena no vincula al Ministerio Público durante el juicio, ni la admisión de los hechos por parte del imputado podrá ser considerada como una confesión.

Si condena, la pena impuesta no podrá superar la requerida por los acusadores.

La sentencia contendrá los requisitos previstos en este Código, de modo sucinto, y será impugnable mediante los recursos y las disposiciones que en este Código se regulan para recurrir la sentencia que se dicta en el proceso penal ordinario.
