La Patria Potestad en Costa Rica
La patria potestad es el conjunto de derechos, atribuciones y deberes que tienen los padres sobre los hijos no emancipados.
La patria potestad corresponde a los padres con independencia de que estén casados entre sí o no, ya que se fundamenta en las relaciones paterno-filiales.
La patria potestad es una potestad familiar, irrenunciable (por ende intransferible e imprescriptible), temporal (se ejerce normalmente hasta la mayoría de edad), relativa (no se trata de un derecho absoluto, sino un poder rector en beneficio de las personas menores de edad del cual no se puede abusar), no transable, en donde sólo una autoridad judicial competente o la misma muerte del titular de tal instituto puede dar fin al mismo.
Se denomina también como «autoridad parental», que es más acorde con el principio de igualdad de derechos y deberes (situaciones jurídicas en general) de las y los cónyuges, los padres y las madres.
La patria potestad termina:
- Por el matrimonio o la mayoridad adquirida del hijo o hija.
- Por la muerte de quienes la ejerzan (progenitores).
- Por la declaratoria judicial de abandono, que se produzca por encontrarse la persona menor de edad en riesgo social y no exista oposición de los padres o cuando, suspendido el derecho, ellos no demuestren haber Modificado la situación de riesgo del menor de edad en el plazo que el Juez les haya otorgado.
- Cuando la persona menor de edad haya sido objeto de violación, abusos deshonestos, corrupción o lesiones graves o gravísimas de quienes la ejerzan (el ofensor sea alguno de las personas progenitoras y sea condenado por la misma causa).
