El mal inquilino / Costa Rica

 

 

 

El inquilino o el arrendatario es quien le alquila el bien mueble o inmueble al arrendador derivado de un contrato de arrendamiento.  El contrato de arrendamiento consiste por el cual una de las partes, llamada arrendador, se obliga a transferir temporalmente el uso y goce de un bien al arrendatario o inquilino, quien a su vez se obliga a pagar por ese uso o goce un precio cierto y determinado. En el caso de una casa o local alquilado, el contrato de arrendamiento puede ser escrito o verbal, lo que no estipule el contrato se rige por defecto en la ley.

Los contratos de arrendamiento de casas y locales en Costa Rica se rige por La ley de arrendamientos Urbanos y Sub Urbanos, donde generalmente se paga mensualmente el alquiler, de allí surge una serie de deberes y derechos de ambos contratantes.

El mal inquilino se caracteriza, por no pagar la renta en el tiempo convenido, atrasarse en el pago, pagar tractos o no pagar nada en absoluto, sin perjuicio de causar daños, hacer escándalos, entre otros. Sin embargo no es tan fácil de que se vaya el mal inquilino, si este no quiere irse, debido a los derechos que conlleva inquilinato. Sacar a una persona a la fuerza, gritar improperios, amenazarla, cambiar el llavín de la casa, o poner candados es una forma de violencia que muchas veces no respalda la autoridad judicial, y este tipo de remedios resultan más nocivos que la enfermedad, debido a que el arrendador podría verse envuelto en una causa penal o una contravención por parte del mal inquilino, por eso lo que se debe hacer es interponer un proceso de desahucio
