EL CAMINO DEL DELITO
El «Iter Criminis» O Fases De Realización Del Delito.
El delito no aparece de improviso, obedece a un proceso, lo que los clásicos denominaban, el «camino del delito» o “iter criminis”.
Para llegar a la consumación del delito, es necesario seguir un “camino”, que va, desde la idea de cometerlo—que surge en la mente del sujeto—, hasta la consumación. Ese conjunto de actos para llegar al delito, se denomina “iter criminis” o “camino del delito”.
La Importancia de las fases reside en que algunos de estos actos son punibles, en tanto que otros no lo son.
FASE INTERNA
Fase Interna. Conjunto de actos voluntarios del fuero interno de la persona que no entran en el campo sancionatorio del Derecho Penal.
Pertenecen a esta fase interna la:
La Concepción o ideación. Es el momento en que surge en el espíritu y mente del sujeto la idea o propósito de delinquir.
La Deliberación.Es el momento de estudio y apreciación de los motivos para realizar el delito.
La Resolución o determinación. Es el momento de decisión para realizar el delito sobre la base de uno de los motivos de la fase anterior. Se resuelve en el fuero interno “el ejecutar la infracción penal”.
Estos actos no pueden ser sancionados porque están en el fuero interno del individuo.
Inpunibilidad de los actos de la fase interna
Loa actos descritos permanecen en el fuero interno del individuo. Por lo tanto, los actos de la fase interna, no son punibles. Por las siguientes razones:
Por respeto al Principio “cogitationen poenam nemo patitur” , pues debe tenerse presente que el delito es, antes que nada, acción.
Si esta en el fuero interno aun no hay acción, y para que haya acción, no bastan los actos internos (elemento psíquico de la acción), sino que se requiere también la exteriorización (elemento físico de la acción).
Porque lo anterior está apoyado por la Constitución que establece: las acciones que no ofendan y no estén prohibidas no son sancionables
FASE INTERMEDIA
Fase Intermedia. Actos intermedios que no causan daño objetivo y que se expresan en la determinación de cometer un delito o resolución manifestada.
La resolución manifestada se expresa en forma de: conspiración, instigación y amenazas.
«La conspiración es el ponerse de acuerdo tres o más personas para cometer los delitos de sedición o rebelión. La conspiración es punible como delito especial.
Instigación. Es el acto de determinar a otra persona a cometer un hecho punible, del cual será considerado autor plenamente responsable.
“Es instigador quien intencionalmente determina a otro a cometer un delito». La proposición es simplemente invitar, la provocación es proponer pero sin convencer.
«Las amenazas son expresiones verbales, escritas o mediante armas con el propósito de amedrentar o alarmar». Es punible como un delito especial, no por el daño posible sino por la peligrosidad del agente.
Estas aunque no causen daño pueden causar alteraciones públicas y son sancionados como «delitos especiales» .
A esta fase también pertenecen el delito putativo y la apología del delito.
Delito putativo. O delito Imaginario. Acto en el cual el autor cree, por error, que está cometiendo un hecho punible y delictivo, pero en realidad no lo es.
Uno cree que el adulterio es delito, cae en esta conducta y se estima autor de un delito. No se sanciona porque el adulterio
FASE EXTERNA
Fase Externa. Manifestación la idea delictiva y comienza a realizarse objetivamente.
Va desde la simple manifestación de que el delito se realizará, hasta la consumación del mismo
Es en esta fase en que el delito cobra vida, y esta compuesta por:
Los Actos Preparatorios , y
La Proposición,
La Conspiración,
La Provocación,
La Incitación, Inducción
Las Amenazas
Los Actos De Ejecución.
La Tentativa
El Delito Frustrado o tentativa acabada
El Delito Imposible
El Delito Consumado
El Delito Agotado
