LA “VICTIMODOGMÁTICA” PENAL
Desde hace tiempo se viene hablando de “Victimodogmática”, como aquella orientación sistemática que se dedica a analizar las incidencias de la Victimología en el ámbito de la teoría del delito y en los tipos penales, es decir –dentro de la dogmática penal. La hipótesis central de esta Victimodogmática se basa en los descubrimientos de la Victimología de que ciertas víctimas provocan o favorecen el hecho delictivo, creando una “co-responsabilidad” que influye sobre la calificación jurídico-penal de la conducta del autor, en términos de atenuar su responsabilidad o eximirla totalmente
de ella.El planteamiento no es nuevo, ya lo encontramos en Mendelsohn, en su obra fundacional, en donde realiza una primera clasifi cación de las víctimas, de acuerdo a su culpabilidad, y reconoce una escala que va desde una víctima totalmente inocente, hasta una víctima culpable. Schünemann habla de una fi gura dogmática de la parte general, gemela de las aportaciones de la víctima y representada por el principio de autorresponsabilidad. La imposición de la pena como última ratio del Estado, no es apropiada en aquellos casos en los cuales la víctima no merece protección o no necesita de protección.
