La Libertad Condicional en costa Rica
Este beneficio no lo otorga el Ministerio de Justicia y Paz, sino que se regula en el Código Penal y es una competencia de los Juzgados de Ejecución de la Pena del Poder Judicial, por lo que debe solicitarse aquí a través de los defensores públicos o particulares.
El privado de libertad tiene derecho a solicitarla una vez que cumpla la mitad de la pena y no haber sido sentenciado antes por delito que tenga pena de prisión mayor a seis meses.
Para ello, el Instituto Nacional de Criminología solicita al Director de cada centro, los informes técnicos para emitir una recomendación al Juzgado de Ejecución de la Pena. Lo resuelto por el Juzgado puede ser apelado ante el Tribunal Sentenciador durante los tres días hábiles siguientes a la notificación.
La libertad condicional podrá revocarse si el beneficiario no cumple las condiciones fijadas por el juez o si durante el período de prueba comete nuevo ilícito sancionado con pena de prisión superior a seis meses.
