Prescripción de demandas comerciales Costa Rica

Del Plazo de la Prescripción

 

ARTÍCULO 984.- Salvo lo expresamente dispuesto en otros capítulos de este Código, todo derecho y su correspondiente acción prescriben en cuatro años, con las siguientes salvedades que prescribirán en un año:

 

a) Las acciones de nulidad de los acuerdos tomados por las asambleas de accionistas o consejos de administración de sociedades comerciales; las de reclamaciones por vicios de las cosas vendidas con garantía de buen funcionamiento; y las de responsabilidad de los administradores, gerentes, directores y demás miembros de la administración de sociedades;

 

b) Las acciones para cobrar intereses, alquileres, arrendamientos o rentas;

 

c) Las acciones de los empresarios, para cobrar el valor de las obras que ejecutaren por destajo;

 

d) Las acciones para cobrar el uso de cualquier otro derecho sobre bienes muebles; y

 

e) (Derogado por el artículo 24 de la Ley Marco del Contrato de Factoreo, N° 9691 del 3 de junio de 2019)

ARTÍCULO 985.- Las prescripciones que establece este capítulo son extintivas y no cabe contra ellas más excepción que la de suspensión cuando ésta legalmente se haya operado, y el mal cómputo en los términos.

ARTÍCULO 986.- Si para el cobro de una obligación comercial se planteare demanda y en ésta recayere sentencia, el término de la prescripción será el que conforme el artículo 984 corresponda a la obligación de que se trate, comenzando a correr desde la firmeza del fallo.
