Cuentos chinos que endurecen los corazones de los juzgadores

Un cuento chino es una historia disfrazada de ardid, concepto difícil de encontrar en su génesis histórica, pero que a nivel judicial costarricense se escucha muy a menudo.

En los juicios los imputados algunas veces dicen verdades y otras veces dicen mentiras, a estas mentiras les dicen cuentos chinos, “yo no fui” , “ese no soy yo”, “me hicieron un montaje”, “me denunciaron por venganza”. Contexto de historias ficticias difíciles de creer, que por su alto contenido imaginativo, no acorde con la realidad, no van a servir para no ir a la cárcel.

Los cuentos chinos sí funcionan para los delitos especiales, como por ejemplo los delitos fiscales, que solo algunos los pueden contar, pero no les sirven a los que se roban galletas. Clientela definida con demasiados problemas encima no luce bien, ni ante jueces, ni ante fiscales, son segregados con etiquetas amplificadas de indeseables, unos dicen la verdad y otros no, los que mienten no hay cuento chino que los salve de ir a la cárcel.

Decir que confundió la casa de su amigo, que no está presente, al cual le estaba haciendo el favor de mudarse destruyendo portones en casa ajena llevándose objetos de valor, no es buen cuento chino en la causa de un robo agravado, aquí el imputado sin dudas termina directamente en la cárcel.

Inventando pésimos cuentos, muchos mentirosos tienen hasta el cuello a los jueces y magistrados, hacen que se endurezcan sus corazones y a algunos los metan a la cárcel sin pruebas, debido a los prejuicios por sus etiquetas amplificadas, como ha dicho un tal Howard Becker, que es sociólogo.

Los cuentos chinos endurecen los corazones de los jueces penales, y pasa como el cuento del pastor mentiroso, por mentir mucho ya nadie le hace caso.

Ya se obtuvo mala fama en forma indeleble, se contagia a los demás, sus análogos ya están prejuiciados, se genera desviación y criminalización secundaria, dijo el juez Zaffaroni, los discriminan y se discriminan a sí mismos, los que ya son malos siguen siendo malos y los que no eran malos ahora se hacen malos.
