Aceptación de dádivas por un
acto cumplido
El delito de aceptación de dádivas por un
acto cumplido se encuentra regulado en
el numeral 350 del Código Penal y hace
referencia a los delitos de cohecho propio e
impropio, estableciendo una reducción de un
tercio de la pena cuando:
“el funcionario público que, sin
promesa anterior, aceptare una dádiva
o cualquier otra ventaja indebida por
un acto cumplido u omitido en su
calidad de funcionario.”

El tipo de cumple con la sola aceptación de la
dádiva, y cuando se trate de un acto cumplido
por el funcionario, es decir, sin promesa
previa, pero como una “recompensa” por
su actuación irregular. Es un delito doloso
pues requiere del conocimiento pleno del
funcionario que lo comete, de tal manera,
que estamos ante el dolo directo y puede
realizar por acción, ante un acto cumplido,
o por omisión, cuando se dejó de realizar
alguna cosa.
Su autor es todo funcionario público que
acepte una dádiva o cualquier ventaja
indebida por una actuación ya cumplida o
que no haya realizado hasta esa fecha.
