Detención El Ministerio Público podrá ordenar que una persona sea detenida, cuando:

 

a) Sea necesaria la presencia del imputado y existan indicios comprobados para sostener, razonablemente, que es autor de un delito o partícipe en él, y que puede ocultarse, fugarse o ausentarse del lugar.

 

b) En el primer momento de la investigación sea imposible individualizar a los imputados y a los testigos y deba procederse con urgencia para no perjudicar la investigación, a fin de evitar que los presentes se alejen del lugar, se comuniquen entre sí y que se modifique el estado de las cosas y de los lugares.

 

c) Para la investigación de un delito, sea necesaria la concurrencia de cualquier persona.

 

La detención no podrá superar las veinticuatro horas. Si el Ministerio Público estima que la persona debe quedar detenida por más tiempo, la pondrá inmediatamente a la orden del tribunal del procedimiento preparatorio y le solicitará ordenar la prisión preventiva o aplicar cualquier otra medida sustitutiva. En caso contrario, ordenará su libertad.
