Artículo 246.-Ofrecimiento fraudulento de efectos de crédito Quien ofrezca al público bonos de cualquier clase, acciones u obligaciones de sociedades mercantiles disimulando u ocultando hechos o circunstancias verdaderas o afirmando o haciendo entrever hechos o circunstancias falsas, será sancionado con pena de prisión de seis meses a dos años. La pena podrá ser aumentada hasta el doble, cuando se trate de oferta pública de valores.
(Así reformado por el artículo 184 de la Ley Reguladora del Mercado de Valores; No.7732 de 17 de diciembre de 1997)

Publicación y autorización de balances falsos.
Artículo 247.-El fundador, director, administrador, gerente, apoderado, síndico o fiscal de una sociedad mercantil o cooperativa o de otro establecimiento comercial que, a sabiendas, publique o autorice un balance, una cuenta de ganancias y pérdidas o las correspondientes memorias, falsos o incompletos, será sancionado con la pena de prisión de seis meses a dos años. La pena podrá ser aumentada hasta el doble, cuando se trate de una entidad que realiza oferta pública de valores.
(Así reformado por el inciso b) del artículo 184 de la Ley Reguladora del Mercado de Valores; No.7732 de 17 de diciembre de 1997)

Autorización de actos indebidos.
Artículo 248.-El director, administrador, gerente o apoderado de una sociedad comercial o cooperativa que, a sabiendas, preste su concurso o consentimiento a actos contrarios a la ley o a los estatutos, de los cuales pueda derivar algún perjuicio para su representada o para el público, será sancionado con pena de prisión de seis meses a dos años. La pena podrá ser aumentada hasta el doble, cuando se trate de un sujeto que realiza oferta pública de valores.

Propaganda desleal.
Artículo 249.-Será reprimido con treinta a cien días multa, al que, por maquinaciones fraudulentas, sospechas malévolas o cualquier medio de propaganda desleal, tratare de desviar en provecho propio o de un tercero la clientela de un establecimiento comercial o industrial.
(Nota de Sinalevi: Mediante el artículo 60 de la Ley de Promoción de la Competencia Nº 7472 de 20 de diciembre de 1994 amplía este tipo penal al duplicar sus penas cuando la acción sea cometida en perjuicio de los consumidores, en los términos del artículo 2º de dicha ley. Además, indica dos supuestos más en que dichas penas se aplicarán, según el monto del daño causado o el número de productos o servicios transados)

Libramiento de cheques sin fondo.
Artículo 250.-Será reprimido con prisión de seis meses a tres años, o con sesenta a cien días multa, el que librare un cheque, si concurren las siguientes circunstancias y el hecho no constituye el delito contemplado en el artículo 221:
1) Si lo girare sin tener provisión de fondos o autorización expresa del banco, y si fuere girado para hacerlo en descubierto;
(Corregido el inciso anterior mediante Fe de Erratas publicada en La Gaceta N° 102 del 27 de mayo del 1982. Posteriormente fue anulada por Resolución de la Sala Constitucional Nº 2994-92 de las 14:55 horas del 6 de octubre de 1992, por lo que dicho inciso conserva la redacción dada por la reforma hecha por la ley N° 6726 del 10 de marzo de 1982).
2) Si diese contraorden de pago, fuera de los casos en que la ley autoriza para ello;
3) Si lo hiciere a sabiendas de que al tiempo de su presentación no podrá ser legalmente pagado.
En todo caso el librador deberá ser informado personalmente de la falta de pago, mediante acta notarial, o por medio de la autoridad que conozca del proceso. Quedará exento de pena, si abonare el importe del cheque dentro de los cinco días siguientes a la notificación.

Artículo 250 bis.-Sufrirá prisión de seis meses a tres años, o sesenta a cien días multa, el que, a sabiendas, recibiere un cheque librado sin provisión de fondos o emitido en descubierto, sin autorización expresa del banco.
