Robo simple.

Artículo 212.- El que se apoderare ilegítimamente de una cosa mueble,

total o parcialmente ajena, será reprimido:

1) Con prisión de uno a seis años, cuando el hecho fuere cometido con

fuerza sobre las cosas; y

2) Con prisión de tres a nueve años, cuando el hecho fuere cometido

con violencia sobre las personas.

Robo agravado.

Artículo 213.- Se impondrá prisión de cinco a quince años:

1) Si el robo fuere perpetrado con perforación o fractura de pared,

cerco, techo, piso, puerta o ventana de un lugar habitado o sus

dependencias;

2) Si el robo fuere cometido con armas; y

3) Si concurriere alguna de las circunstancias de los incisos 1), 2),

5), 6), 7), 8) del artículo 209.

Los casos de agravación y atenuación de la pena fijados para el delito

de hurto serán también atenuantes y agravantes del robo y la pena será

fijada por el Juez de acuerdo con el artículo 71.

El robo es un delito contra el patrimonio, consistente en el apoderamiento de bienes ajenos de otras personas de manera fraudulenta, empleando para ello fuerza en las cosas o bien violencia o intimidación en las personas. Son precisamente estas dos modalidades de ejecución de la conducta las que la diferencia del hurto, que exige únicamente el acto de apoderamiento.
