LEY ORGÁNICA DEL MINISTERIO PÚBLICO DE COSTA RICA

 

 

LEY Nº 7442[1]

 

 

(NOTA: el artículo 11 de la Ley de Reorganización Judicial Nº 7728 de 15 de diciembre de 1997 modificó íntegramente el texto de la presente ley, en la forma que sigue:)

 

CAPÍTULO I

DISPOSICIONES GENERALES

 

Artículo 1.- Principios y ubicación. El Ministerio Público es un órgano del Poder Judicial y ejerce sus funciones en el ámbito de la justicia penal, por medio de sus representantes, conforme a los principios de unidad de actuaciones y dependencia jerárquica, con sujeción a lo dispuesto por la Constitución Política y las leyes.

 

Artículo 2.- Funciones. El Ministerio Público tiene la función de requerir ante los tribunales penales la aplicación de la ley, mediante el ejercicio de la acción penal y la realización de la investigación preparatoria en los delitos de acción pública.

No obstante, cuando la ley lo faculte, previa autorización del superior, el representante del Ministerio Público podrá solicitar que se prescinda, total o parcialmente, de la persecución penal, que se limite a alguna o varias infracciones o a alguna de las personas que participaron en el hecho.

Deberá intervenir en el procedimiento de ejecución penal, en la defensa civil de la víctima cuando corresponda y asumir las demás funciones que la ley le asigne.

 

Artículo 3.- Independencia funcional. El Ministerio Público tendrá completa independencia funcional en el ejercicio de sus facultades y atribuciones legales y reglamentarias y, en consecuencia, no podrá ser impelido ni coartado por ninguna otra autoridad, con excepción de los Tribunales de Justicia en el ámbito de su competencia.

 

 

Artículo 4.- Dirección de la Policía Judicial. El Fiscal General podrá requerir informes de la Dirección General del Organismo de Investigación Judicial cuando exista lentitud o deficiencias en algún departamento o sección del Organismo de Investigación Judicial. En estos casos, cuando lo estime conveniente, el Fiscal General podrá establecer las directrices y prioridades que deben seguirse en la investigación de los hechos delictivos.

Existirá una comisión permanente, integrada por el Fiscal General de la República, el Director del Organismo de Investigación Judicial y dos funcionarios más de cada uno de estos entes, designados por sus respectivos jerarcas, con la finalidad de coordinar funciones y evaluar, periódicamente, la labor. Dicha comisión la presidirá el Fiscal General.

Además de lo anterior, el Fiscal General de la República, el Director del Organismo de Investigación Judicial, y los directores de las policías administrativas, se reunirán periódicamente para coordinar estrategias y políticas por seguir en la investigación de los delitos.

 

Artículo 5.- Publicidad. El Ministerio Público no podrá dar información que atente contra el secreto de las investigaciones o que, innecesariamente, pueda lesionar los derechos de la personalidad. Sin embargo, sus funcionarios podrán, extrajudicialmente, dar opiniones de carácter general y doctrinario acerca de los asuntos en que intervengan.

 

Artículo 6.- Visita a cárceles. Los funcionarios del Ministerio Público, en defensa de la legalidad penal, entre otras actuaciones, podrán visitar los centros o establecimientos de detención -penitenciarios o de internamiento de cualquier clase- examinar los expedientes de los internos y recabar cuanta información estimen conveniente.

 

Artículo 7.- Competencia Territorial.En el ejercicio de sus funciones, los representantes del Ministerio Público actuarán en cualquier lugar del territorio nacional.

Corresponderá al Fiscal General, o al superior designado al efecto, establecer el territorio en que los fiscales ejercerán sus funciones, lo que podrá ser variado mediante resolución motivada por razones de mejor servicio público.

Si se produjeren conflictos sobre la distribución de trabajo serán resueltos por el superior.

En el ejercicio de sus funciones los representantes del Ministerio Público podrán actuar fuera de horas o días hábiles.

 

Artículo 8.- Formalidad de actuaciones. Los representantes del Ministerio Público formularán, motivada o específicamente, sus requerimientos, dictámenes y conclusiones; procederán oralmente en los debates y vistas y, por escrito en los demás casos, todo de conformidad con lo dispuesto en el Código de Procedimientos Penales.

 

Artículo 9.- Citación de personas. En asuntos sometidos a su intervención, los representantes del Ministerio Público podrán citar u ordenar la presentación de cualquier persona, siempre que sea procedente.

 

Artículo 10.- Responsabilidades. Los funcionarios del Ministerio Público serán responsables penal y civilmente por sus actuaciones.

 

Artículo 11.- Cauciones. El Fiscal General deberá rendir caución por el monto de catorce salarios base, según la regla establecida en la Ley Orgánica del Poder Judicial. El resto de los fiscales rendirán caución por el monto fijado para los jueces de Tribunal Colegiado.

 

CAPÍTULO II

DE LA UNIDAD Y DEPENDENCIA JERÁRQUICA

 

Artículo 12.- Sede. El Ministerio Público es único para toda la República. La sede de la Fiscalía General se ubica en la capital.

 

Artículo 13.- Jerarquía e instrucciones. El Fiscal General de la República es el Jefe Superior del Ministerio Público y su representante en todo el territorio nacional. Este deberá dar a sus subordinados las instrucciones generales o especiales sobre la interpretación y la aplicación de las leyes, a efecto de crear y mantener la unidad de acción e interpretación de las leyes en el Ministerio Público.

 

Las instrucciones deberán impartirse, regularmente, en forma escrita y transmitirse por cualquier vía de comunicación, inclusive por teletipo.

En caso de peligro por demora, las instrucciones podrán ser impartidas verbalmente y confirmadas por escrito inmediatamente después.

 

Artículo 14.- Principio de jerarquía. Los fiscales deberán acatar las orientaciones generales e instrucciones que el superior jerárquico imparta sobre sus funciones.

En los debates y las audiencias orales, el fiscal actuará y concluirá conforme a su criterio. Sin embargo, observará las instrucciones generales impartidas por el superior, sin perjuicio de que  este último lo sustituya, si lo considera necesario.

 

Artículo 15.- Representación y sustitución. Los funcionarios del Ministerio Público actuarán siempre por delegación y bajo la dependencia del Fiscal General.

 

Artículo 16.- Intervención válida. Para intervenir válidamente, a los miembros del Ministerio Público les bastará comparecer ante los tribunales de justicia, instituciones u organismos públicos o privados, en los cuales deban ejercer actos propios de su cargo.

 

Artículo 17.- Desistimiento. El Ministerio Público, mediante dictamen fundado, tendrá facultad para desistir de sus recursos, excepciones, incidentes o articulaciones, aun si los hubiere interpuesto con representantes de grado inferior.

 

Artículo 18.- Enmienda. El superior jerárquico podrá enmendar, mediante dictamen fundado y con indicación del error o errores cometidos, los pronunciamientos o solicitudes del inferior, mientras no se haya dictado la resolución correspondiente.

Igualmente, una vez dictadas estas resoluciones o cualesquiera otras, dicho superior podrá ordenar a otro representante del Ministerio Público la interposición de los recursos que la ley autoriza, o que se haga cargo de la continuación del procedimiento.

 

Artículo 19.- Reconsideración. Contra las órdenes e instrucciones del superior jerárquico, solamente procederá su reconsideración, cuando quien las reciba le haga saber a aquel, mediante escrito fundado, que las estima contrarias a la ley o improcedentes, por el motivo o motivos que aducirá.

El superior podrá ratificarlas, modificarlas o revocarlas, según lo estime procedente.

La ratificación se dictará, de manera razonada, con expresa liberación para el subordinado de las responsabilidades que se originen de su cumplimiento. En esta situación, el superior podrá delegar el caso en otro funcionario.

 

CAPÍTULO III

DE LA ORGANIZACIÓN

 

Artículo 20.- Órganos. Son órganos del Ministerio Público:

  1. a) El Fiscal General de la República
  2. b) Los fiscales adjuntos
  3. c) Los fiscales
  4. d) Los fiscales auxiliares

 

Artículo 21.- Estructura básica. El Ministerio Público se organizará en fiscalías adjuntas, que actuarán en un determinado territorio o por especialización, según se requiera para un buen servicio público. Serán creadas por la Corte Plena a propuesta del Fiscal General y podrán ser permanentes o temporales.

A las fiscalías adjuntas se adscribirán las fiscalías y las fiscalías auxiliares necesarias, según la actividad o el territorio en  que deban cumplir sus funciones.

Estas oficinas tendrán el personal de apoyo indispensable para desempeñar, adecuadamente, su función.

 

Artículo 22.- Órgano asesor. El Consejo Fiscal del Ministerio Público será el órgano asesor del Fiscal General de la República.

Sesionará por lo menos una vez cada seis meses o cuando lo convoque el

Fiscal General. Estará integrado por los siguientes fiscales:

  1. a) El Fiscal General de la República, quien lo presidirá, por sí o por delegación.
  2. b) Los fiscales adjuntos.

A ese Consejo le corresponderá colaborar con el Fiscal General, en la definición de la política que deba seguir el Ministerio Público y la Policía Judicial, en cuanto a la investigación y persecución penales y en los asuntos que el Fiscal General le someta.

Otorgará, además, distinciones honoríficas por desempeño sobresaliente en el cumplimiento de labores.

 

CAPÍTULO IV

DEL FISCAL GENERAL DE LA REPÚBLICA

Artículo 23.- Requisitos para su nombramiento. El Fiscal General de la República será nombrado por mayoría absoluta de la totalidad de integrantes de la Corte Plena, por períodos de cuatro años. Podrá ser reelegido por períodos iguales.

Este Fiscal deberá reunir los mismos requisitos que se exigen para ser magistrado y rendirá juramento ante la Corte Plena. Su remuneración no podrá ser inferior a la de juez de casación penal.

Quien haya sido nombrado y ocupe en propiedad algún cargo en la Administración Pública, se suspenderá en el ejercicio de este último; pero, conservará el derecho de reintegrarse a ese puesto, con el salario que corresponda a tal cargo, una vez que termine en sus funciones como Fiscal General. Todo ello, siempre que no haya vencido el período para el que fue nombrado en ese otro puesto, no haya sido reelegido en él, o no hubiere sido despedido.

 

Artículo 24.- Régimen disciplinario y detención. Para aplicar sanciones al Fiscal General se seguirá el procedimiento establecido en la Ley Orgánica del Poder Judicial, pero la revocatoria del nombramiento requerirá el voto de las dos terceras partes del total de miembros de la Corte Plena.

El Fiscal General de la República no gozará del privilegio constitucional. Sin embargo, sólo podrá ser detenido por orden del juez, en virtud de auto de apertura a juicio firme dictado en su contra o por haber sido sorprendido en flagrante delito.

 

Artículo 25.- Deberes y atribuciones. Son deberes y atribuciones delFiscal General:

  1. a) Determinar la política general del Ministerio Público y los criterios para el ejercicio de la acción penal.
  2. b) Establecer la política general y las prioridades que deben orientar la investigación de los hechos delictivos.
  3. c) Impartir instrucciones, de carácter general o particular, respecto del servicio y ejercicio de las funciones del Ministerio Público y de los funcionarios y servidores a su cargo.
  4. d) Integrar equipos conjuntos de fiscales y policía judicial para la investigación de casos específicos o, en general, para combatir formas de delincuencia particulares; en tales casos las autoridades policiales no podrán ser separadas sin la expresa aprobación del representante del Ministerio Público.
  5. e) Establecer la organización del Ministerio Público por medio de fiscalías territoriales o especializadas, permanentes o temporales.
  6. f) Ejercer la administración y disciplina del Ministerio Público.
  7. g) Efectuar y revocar nombramientos, ascensos, permutas y traslados de los fiscales y aceptar sus renuncias.
  8. h) Conceder licencias sin goce de sueldo hasta por un año; los jefes de oficina también podrán otorgar dichas licencias por lapsos máximos de una semana.
  9. i) Presentar ante la Corte Plena una memoria anual sobre el trabajo realizado, que incluya las políticas de persecución penal e instrucciones generales establecidas, la previsión de recursos, las propuestas jurídicas y cualquier otro tema que el Fiscal General estime conveniente. Dicha memoria deberá ser presentada por lo menos, un mes antes de la inauguración del año judicial.
  10. j) Practicar, personalmente, la investigación inicial y solicitar lo que corresponda, intervenir en los juicios, así como asumir todas las funciones que corresponden al Ministerio Público, en los procesos penales seguidos contra los miembros de los Supremos Poderes y funcionarios equiparados. En estos casos podrá hacerse acompañar de un fiscal.
  11. k) Asumir, personalmente, cuando lo estime oportuno, las funciones que la ley le otorga al Ministerio Público.
  12. l) Representar al Ministerio Público en audiencias orales ante la Sala de Casación Penal de la Corte Suprema de Justicia, sin perjuicio de delegar, en forma parcial y por razones motivadas, esa función en sus subalternos.
  13. m) Las demás que las leyes y el reglamento de la presente ley le atribuyan.

 

Artículo 26.- Sustitución. En las ausencias temporales y en las definitivas, mientras no se produzca el nombramiento del propietario, así como en los casos de excusa o recusación, el Fiscal General de la República será sustituido por el Fiscal Adjunto que designe la Corte Suprema de Justicia, de una terna de suplentes que cada año enviará el Fiscal General.

 

CAPÍTULO V

DE LOS FISCALES ADJUNTOS, FISCALES Y FISCALES AUXILIARES

 

Artículo 27.- Del ingreso y del ascenso. Corresponde al Fiscal General el nombramiento por nómina de los fiscales adjuntos, fiscales y fiscales auxiliares, los cuales deberán ser mayores de edad, costarricenses, de reconocida solvencia moral, poseer idoneidad para el puesto y el título de abogado.

De existir línea de ascenso se podrá autorizar la promoción de un servidor a un puesto de grado superior sin necesidad de concurso.

Para ingresar al Ministerio Público se procurará cumplir con el programa de ingreso que reglamentará la Corte, a propuesta del Fiscal General y de la Escuela Judicial. Este programa podrá desarrollarse con instituciones públicas o privadas.

Para ser nombrado en propiedad como Fiscal Adjunto se requerirá un mínimo de dos años de experiencia efectiva como fiscal; para ser nombrado fiscal se requerirá una experiencia efectiva de un año como fiscal auxiliar.

 

Artículo 28.- Del régimen disciplinario. Los funcionarios y empleados del Ministerio Público estarán sometidos al régimen disciplinario y laboral que establece la ley Orgánica del Poder Judicial.

Sin embargo, corresponde al Fiscal General conocer del recurso de apelación de la resolución del Tribunal de la Inspección Judicial que revoque el nombramiento a un fiscal adjunto, fiscal o fiscal auxiliar.

Artículo 29.- Funciones generales. Los fiscales adjuntos, fiscales y fiscales auxiliares actuarán en representación del Ministerio Público en todas las fases del procedimiento penal. En los casos de su conocimiento podrán actuar en todo el territorio nacional, sin perjuicio del auxilio mutuo que deben prestarse.

Estos funcionarios podrán actuar en forma conjunta y en coordinación con los órganos fiscalizadores de las instituciones públicas cuando estas realicen investigaciones de interés público y haya sospecha de la comisión de delitos.

El fiscal a cargo de la investigación de un delito debe identificar y reunir los elementos de convicción de forma que permita el control del superior, la defensa, la víctima, el querellante, las partes civiles y del juez.

 

Artículo 30.- Funciones específicas. Corresponde al fiscal adjunto dirigir y coordinar la fiscalía adjunta que se establezca ya sea territorial o especializada. De él dependerán los fiscales y fiscales auxiliares adscritos a la fiscalía.

En especial el fiscal adjunto distribuirá las labores y los casos entre los funcionarios a su cargo, siguiendo las directrices del Fiscal General.

Corresponde al fiscal asumir, personalmente, las labores de investigación y el ejercicio de las acciones que correspondan al Ministerio Público. De ellos dependerán directamente los fiscales auxiliares que se le adscriban, según la distribución de trabajo que disponga el Fiscal General.

Los fiscales auxiliares actuarán en las etapas preparatoria e intermedia, sin perjuicio de participar excepcionalmente en las fases sucesivas del procedimiento.

 

Artículo 31.- Fiscalías especializadas. Las fiscalías especializadas intervendrán, en todo o en parte, en las etapas del proceso penal, con las mismas facultades y obligaciones de las fiscalías adjuntas territoriales, en actuación separada o en colaboración con estas.

Existirán al menos dos fiscalías especializadas, una en los hechos ilícitos, cuya competencia corresponde a la Jurisdicción Penal de Hacienda y de la Función Pública y otra en los hechos relacionados con el narcotráfico.

Artículo 32.- Unidades especializadas. El Fiscal General podrá crear unidades especializadas que actuarán, temporalmente, en parte o en todo el territorio nacional, en forma conjunta o separada con las fiscalías de la circunscripción correspondiente.

Dichas unidades podrán ser designadas en relación con uno o varios casos, o para funciones específicas.

A estas unidades podrán adscribirse los investigadores policiales que designe el Fiscal General.

 

CAPÍTULO VI

DE LA OFICINA DE DEFENSA CIVIL DE LAS VÍCTIMAS

 

Artículo 33.- Funciones. La oficina de defensa civil de las víctimas estará adscrita al Ministerio Público y a cargo de un abogado con categoría de fiscal adjunto. Además de ejercer la acción civil resarcitoria, este abogado, velará en general por el respeto de los derechos de las víctimas, derivados de delitos de acción pública, para lo que podrá ejercer las actuaciones y gestiones que resulten necesarias, inclusive fuera del proceso penal.

 

Artículo 34.- Asistencia legal. El Ministerio Público proveerá a la víctima que le delegue el ejercicio de la acción civil resarcitoria, un profesional en derecho. Esta función puede ser asumida, directamente, por un abogado de la oficina de defensa civil a las víctimas, o por cualquiera de los representantes del Ministerio Público en el territorio nacional, según la distribución de trabajo que apruebe el Fiscal General.

La autoridad que tramite la causa le advertirá al asistido que, si se demuestra que tiene solvencia económica, deberá designar un abogado particular, o bien pagar al Poder Judicial los servicios del abogado, según la fijación que hará el juzgador.

 

Artículo 35.- Cobro de honorarios y costas. Cuando corresponda el jefe de la oficina de defensa civil de las víctimas o quien este designe, gestionará ante la autoridad correspondiente la fijación y el cobro de los honorarios por los servicios prestados.

Constituirá título ejecutivo, la certificación que se expida sobre el monto de los honorarios a cargo de la víctima. De oficio, la autoridad que conoce del proceso, ordenará el embargo bienes del deudor, en cantidad suficiente para garantizar el pago de los honorarios. El abogado a quien corresponda hacer las diligencias de cobro, ejercerá todas las acciones judiciales o extrajudiciales para hacerlo efectivo.

La fijación de honorarios se hará en sentencia o en el momento en que la víctima decida prescindir de los servicios de la oficina.

Iguales reglas se aplicarán, en lo que corresponda, para el cobro de costas por honorarios de abogado de la parte actora civil, contra la parte vencida.

Los ingresos provenientes de lo dispuesto en esta norma, serán depositados en una cuenta especial destinada al mejoramiento de la oficina y a la creación de un fondo para satisfacer las necesidades urgentes de las víctimas de delitos. La Corte Plena establecerá los mecanismos adecuados para reglamentar y controlar el uso de tales recursos.

 

CAPÍTULO VII

DEL RÉGIMEN ADMINISTRATIVO

 

Artículo 36.- De la organización administrativa. El Ministerio Público tendrá la organización administrativa necesaria para el buen desempeño de sus funciones, según disponga la Corte Plena a requerimiento del Fiscal General.

 

Artículo 37.- De la unidad administrativa. El Ministerio Público tendrá una unidad administrativa dirigida por un profesional en Ciencias Económicas u otra disciplina afín, nombrado por el Fiscal General de la República, de quien dependerá en forma directa.

 

Artículo 38.- Funciones del administrador. Corresponde al administrador realizar las tareas de administración y organización que le encomiende su superior, así como asesorarlo en los aspectos administrativos y presupuestarios.

Además de lo indicado, tendrá a su cargo el archivo general, la organización y supervisión de las unidades o secciones administrativas y expedirá certificaciones.

Será también el enlace entre la jefatura y los demás órganos, oficinas y servidores del Ministerio Público.

A su cargo estará la recepción y distribución de documentos y comunicaciones, así como la atención del público en la sede de la Fiscalía General.

 

Artículo 39.- La Unidad de Capacitación y Supervisión. Le corresponde a la Unidad de Capacitación y Supervisión organizar los programas de selección, ingreso y capacitación del personal del Ministerio Público, en coordinación con la Escuela Judicial y el Departamento de Personal en lo que corresponda.

Los integrantes de esta unidad deberán desplazarse a las distintas  oficinas del Ministerio Público del país, con el fin de verificar el cumplimiento de las directrices, así como el desempeño de las labores en general, e impartir las instrucciones técnicas necesarias para un mejor servicio público.

Esta oficina será dirigida por un funcionario de amplia experiencia,  que tendrá categoría de fiscal adjunto.

 

 

CAPÍTULO VIII

DE LAS RECUSACIONES Y EXCUSAS

 

Artículo 40.- Causales. Los funcionarios del Ministerio Público deberán excusarse y podrán ser recusados por las mismas causales que enumera la ley Orgánica del Poder Judicial y el artículo 55 del Código Procesal Penal, con excepción de los motivos previstos en los incisos f) y g).

 

Artículo 41.- Sustituciones. El Fiscal General de la República dictará las disposiciones generales necesarias para suplir a los fiscales por motivo de excusa o recusación.

 

Artículo 42.- Trámite de la excusa. El funcionario del Ministerio Público que deba excusarse remitirá las actuaciones al funcionario sustituto, indicando las razones en que funda su excusa. Si este acepta la excusa continuará con el conocimiento del asunto e informará al superior; en caso contrario, remitirá los antecedentes al superior inmediato quien resolverá en definitiva sin trámite alguno.

 

Artículo 43.- Recusación. Cuando se estime que procede la recusación  de un fiscal, cualquiera de las partes podrá solicitarle, mediante petición fundada, que se inhiba de conocer el asunto. Si el fiscal la acoge procederá conforme a lo dispuesto para la excusa.

Si el fiscal no acogiere la recusación inmediatamente, procederá a remitirla al tribunal en que esté actuando, junto con las razones por las que no la aceptó. El tribunal, sin mayor trámite, procederá a resolver lo pertinente. Si el asunto se encuentra en investigación fiscal, la recusación será presentada ante el tribunal de la etapa preparatoria.

Si el tribunal admitiere la recusación lo comunicará al superior inmediato del recusado, para que lo sustituya y, si es necesario, proceda conforme establece el régimen disciplinario.

 

CAPÍTULO IX

DISPOSICIONES VARIAS

 

Artículo 44.- De los recursos. El Poder Judicial proveerá las necesidades materiales del Ministerio Público; para dicho efecto este le presentará, a la Comisión de Presupuesto, un anteproyecto de presupuesto para el ejercicio fiscal siguiente, en el que se garanticen los recursos necesarios para un eficiente servicio.

 

Artículo 45.- Normas aplicables. Los funcionarios yEMPLEADOS del Ministerio Público gozarán del derecho de estabilidad y solo podrán ser removidos conforme se establece en el Estatuto de Servicio Judicial, con la intervención del Fiscal General, que se acuerda en la presente Ley.

 

 

Artículo 46.- Sanciones de los jefes de oficina. Los jefes de oficina también podrán imponer sanciones disciplinarias a susEMPLEADOS subalternos, siempre que no excedan de quince días de suspensión. En el caso de suspensión cabrá recurso de apelación ante el Fiscal General.

 

Artículo 47.- Sello e insignias. El Ministerio Público tendrá, para su uso oficial, sello, medios de identificación, insignias y emblema propios.

 

Artículo 48.- Incompatibilidad y beneficios. Los funcionarios y empleados del Ministerio Público estarán sometidos a las disposiciones legales en cuanto a incompatibilidades, prohibiciones, beneficios, remuneraciones y demás normas existentes o que se lleguen a promulgar en el futuro, aplicables a los servidores judiciales, no previstas expresamente en esta Ley.
